Joan Rey (Todd) Gray (“plaintiff”) filed suit in the Chancery Court of Marshall County against her former husband, Max Delter Todd, (“defendant”). She sought court-ordered sale of certain farm property held by them as tenants in common and certain farm equipment jointly owned by them at the time of their divorce. Defendant counter-claimed, asserting that as a result of discussions had by the parties at the time the divorce was obtained, an express oral trust in favor of defendant had been created by the parties in both the realty and farm equipment.
