MEMORANDUM OPINION
JOSEPH L. COSETTI, Bankruptcy Judge.
The matter before the court is the Defendant’s motion to dismiss the above adversary proceeding. For the reasons expressed below, the motion is denied.
Facts
On October 10,1991, the debtor, Arthur F. Hazen & Co., Inc., filed a voluntary petition under Chapter 11 of the Bankruptcy Code (“Code”) in the United States Bankruptcy Court for the Western District of Pennsylvania.
