RAMEY, Chief Justice.

On January 29, 1997, this Court issued its original opinion in this cause. Thereafter, Appellant, Guy Edwin Sparkman, filed a motion for rehearing. We grant Appellant’s motion for rehearing as to his request that the opinion be published. Also in response to his motion, we have reconsidered his third point of error, and though we decline to change our initial holding overruling his point, we have rewritten that section of the opinion to clarify our position.
