—In an action to *548recover damages for breach of contract, the defendants Joseph Genova and Diane Genova appeal from an order of the Supreme Court, Kings County (Shaw, J.), dated September 23, 1998, which denied their motion for summary judgment dismissing the complaint insofar as asserted against them and granted the plaintiffs cross motion for summary judgment on the complaint against the appellants and to dismiss their counterclaims.

Ordered that the order is affirmed, with costs.
