The plaintiffs brought this action pursuant to G.L.c. 30A, §14, appealing the Final Decision of Robert Golledge, Commissioner of the Department of Environmental Protection, in which he decided that the defendant North Point Cambridge Land Company is not required to seek a license to build its proposed project because the Waterways Act, G.L.c. 91, and the regulations promulgated under the Act are not applicable to the subject land.
