This is an interlocutory appeal, originally granted by this court on the application of two applicant-defendants, from a judgment that denied the defendants’ motion to dismiss the plaintiffs complaint. After this court had granted the interlocutory appeal, one of the defendants, the employer of the plaintiff, voluntarily dismissed its appeal, and, at the same time, the plaintiff dismissed the employer as a party defendant in the trial court.
