In a probate proceeding, the objectant Jerome S. Stone appeals from a decree of the Surrogate’s Court, Kings County (Bloom, S., at trial; Pizzuto, A.S., on decree), dated October 17, 1988, which, upon granting the petitioner’s motion for judgment as a matter of law, which was made at the close of the evidence at trial, admitted the will of Mildred Stone Posner dated March 15, 1982, to probate.

Ordered that the decree is affirmed, with costs payable by the appellant personally.
