Appeal by the defendant, Barnett & Barse Corporation, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 9 th day of September, 1914, resettling a prior order entered in said clerk’s office on the 26th day of August, 1914, and denying the appellant’s motion to change the place of trial in this action from New York county to Nassau county.

Laughlin, J.:

The motion was made on the ground that the action falls within the provisions of section 982 of the Code of Civil Procedure, and that the issues must be tried in the county of Nassau, where the real estate to which the action relates is situated.
