CHASE, District Judge.

This is an action brought by the administrator of the estate of one George Metzler to recover damages alleged to have resulted from the wrongful death of his intestate while employed by the defendant. The case was submitted to a jury, resulting in a verdict for plaintiff. From the order *347overruling a motion for new trial, the defendant presents the record to this court for review. The case is governed by the provisions of the federal statute known as the “Employers’ Liability Act.”
