Plaintiffs in error are the City of West University Place and its officers. They will be referred to collectively as the City. Defendant in error Houston Lighting and Power Company is a Texas corporation engaged in the business of generating, transmitting and distributing electric current for use by the public. It will be called the Company. The City was incorporated in 1925 by general law. From 1925 to 1930 the Company furnished electric service to the City and its inhabitans without having the formal consent of the City.
