In an action to recover damages for medical malpractice and lack of informed consent, etc., the defendant appeals from an order of the Supreme Court, Queens County (O’Donoghue, J.), entered June 12, 2012, which denied his motion for summary judgment dismissing the complaint.

Ordered that the order is modified, on the law, by deleting the provision thereof denying that branch of the defendant’s motion which was for summary judgment dismissing the cause of action alleging lack of informed consent and substituting therefor a provision granting that branch of the motion; as so modified, the order…
