I. Factual Background

Central Foundry Division, General Motors Corporation (hereinafter “defendant”), is an industrial facility in Lawrence County, Indiana. Complaint, ¶ 2; Answer, ¶ 2. On April 15, 1988, the defendant hired Jungclaus-Campbell Company, Inc.
