The defendant, Willie Jackson, with one Jack Mann, ivas jointly charged in the district court of Oklahoma county with the crime of conducting a gambling game, was tried, convicted, his punishment left to the court, who thereupon sentenced him to serve 18 months in the penitentiary, and he has appealed to this court.
The defendant makes two assignments of error, to wit:(1) That the conrt erred in overruling his demurrer to the indictment.(2) The court erred in overruling his demurrer to the evidence of the state at the close of the state’s case, and in refusing to sustain his motion for an…
