The plaintiff in error, hereinafter called defendant, was convicted in the district court of Muskogee county on a charge of an assault with a danger ous weapon, and his punishment fixed at a term of two years in the state penitentiary.

The theory of the state, as shown by the statement of the county attorney, appears on page 18 of the case-made, and is as follows:
