Appeal by the defendants from a judgment of the Supreme Court, Sullivan Comity, entered upon a verdict of $15,000 for the plaintiff in a negligence action. On March 14, 1956 the plaintiff was riding to work in a car owned by the defendant Leona Evans and driven by the defendant Sol Evans, her husband. Evans was driving at a speed of 45 miles per hour when he came up behind another car proceeding in the same direction. He pulled out to pass and according to his testimony did not accelerate.
