This is an action on the case by the appellee against the appellant for damage to the plaintiff’s automobile, and for personal injuries suffered by the plaintiff in a collision between the plaintiff’s automobile and the defendant’s truck on a public highway.

Some of the counts of the complaint ascribe the plaintiff’s injury and damage to the negligence of the defendant’s servant or agent, while acting in the line and scope of his employment in the operation of the defendant’s truck, in negligently causing or allowing the truck to collide with the plaintiff’s automobile, and others ascribe the…
