The defendants are charged in a criminal court information with the crimes of criminal trespass in the third degree, in violation of Penal Law § 140.10, and obstructing governmental administration in the second degree, in violation of Penal Law § 195.05. The accusations stem from a confrontation on February 15, 2000 in which the defendants and others tried to prevent the City of New York from using bulldozers to clear Esperanza Garden, a lower east side “community garden” located on City-owned property.
