— The appellee filed this suit in the court below, seeking to recover the sum of $1,000 which he claimed as damages resulting from the depreciation in the value of his homestead by reason of the digging of a pool near it by the appellant. It appears from the testimony that the appellant, Sanders, owned a lot consisting of about six or eight acres on the opposite side of a street, in the town of DeKalb, from a lot owned by the appellee and upon which the latter resided.
