CUDAHY, Circuit Judge.
In this race to the courthouse, the plaintiffs, debtors Hoosier Bancorp of Indiana, Inc. (Hoosier) and John Snyder, and guarantor Donald Hedrick, sued Bank One (f/k/a Liberty) pressing various claims and allegations. These included conspiracy between the Office of the Comptroller of the Currency (OCC) and Bank One to prevent Hedrick from participating in Hoosier business managing Rushville National Bank) and to declare Rushville National Bank in default; breach of oral promise; tortious interference with business relations; and a derivative claim for personal recovery.…
