In an action for a judgment declaring that the defendant is not entitled to terminate a lease, the plaintiff appeals from an order of the Supreme Court, Nassau *467County (Roncallo, J.), dated July 1, 1987, which granted the defendant’s motion pursuant to CPLR 3211 to dismiss the complaint.

Ordered that the order is reversed, on the law, with costs, and the matter is remitted to the Supreme Court, Nassau County, for further proceedings consistent herewith.
