Plaintiff McIntyre, with four other residents, property, owners and taxpayers of the city of Colorado Springs, suing for themselves, as well as for all other residents, property owners and taxpayers of the city, commenced this action to restrain the hoard of county commissioners of the county of El Paso, in which the city of Colorado Springs is situate, from the erection of a county courthouse upon a certain public square within the city, which it was claimed had been dedicated and used for twenty-nine years as a public park.
