Defendant, Thomas E. Mitchell, was indicted on two counts of delivery of a controlled substance (Ill. Rev. Stat. 1979, ch. 5Q1k, par. 1401(c)), and convicted by a jury of possession of a controlled substance (Ill. Rev. Stat. 1979, ch. 56V2, par. 1402). The jury found him not guilty of delivery.
