JOYNER, United States Magistrate Judge.
Now before the Court is the Motion by Plaintiff Fleet Business Credit, L.L.C. (“Fleet”) for Appointment of a Receiver over the Real Property of Defendant Huge American Real Estate, Inc. (“Huge”). [Doc. No. 38]. Huge is the owner of nine (9) tracts of real property which have been leased to Defendant Wings Restaurants, Inc. (“Wings”). Wings filed for Chapter 7 bankruptcy on February 20, 2003 in the United States Bankruptcy Court for the Northern District of Texas, Dallas Division, Case No. 03-31-921.
