Appeal by the defendant, City of Ogdensburg, from an order of the Supreme Court, made at the St. Lawrence Special Term and entered in the office of the clerk of the county of St. Lawrence on the 18th day of April, 1914.

Lyon, J.:

This is an appeal from an order denying the motion of the city of Ogdensburg for an order compelling the referees appointed in this action to repair or rebuild, and to keep in repair, the bridges over the canals, conduits and raceways on *652Lake, Main and River streets, in said city, pursuant to a decree entered in this action April 2, 1872. The principal questions in dispute are whether the city of Ogdensburg or the power lot owners are liable for the maintenance of the two bridges over the canal on Lake and Main streets, and the bridge over the raceway on River street.
