Appeal from First City Court of New Orleans; Richard H. Downing, Judge. Joseph Rittenberg, Jacob • Itzkovitch, and Julia Fertel and husband were convicted of selling firearms without a license, and appeal.

The defendants are proceeded against for a license as dealers in pistols and pistol cartridges, under Act No. 83, p. 132, of 1900; and they deny the constitutionality of that act, on the ground that the license it imposes is not “graduated,” as required by article 229 of the Constitution.
The same question was presented to this court in the case of Browne v. Selser, 100 La. 691, 31 South. 290, and the constitutionality of the law upheld.
