Appeal from a judgment of the Supreme Court (Cheeseman, J.), entered December 20, 1991 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to compel respondents to reinstate petitioner as a provider in the Medicaid program.

Petitioner is a clinical laboratory which, until May 9, 1989, provided services to Medicaid recipients.
