I can not concur with my brethren in overruling the motion for rehearing. Appellant challenges the correctness of the opinion affirming the conviction, and presents tersely the issues as follows: First. If the issue of mutual combat be not in the case, the conviction should be set aside. Second. If the issue of mutual combat be held raised by the evidence, then the conviction should be affirmed, unless (1) the charges of the trial court upon the issue of mutual combat are erroneous; or unless (2) the charges of the trial court are erroneous and restrictive of the issue of self-defense; or…
