Appeal from a judgment of the County Court of Chemung County (Danaher, Jr., J.), rendered April 22, 1985, upon a verdict convicting defendant of the crime of assault in the second degree.
On September 20, 1984, defendant, an inmate at Elmira Correctional Facility in Chemung County, was indicted for, *478inter alia, attempted murder in the second degree (Penal Law § 125.25 [1]; § 110.00) and assault in the second degree (Penal Law § 120.05 [2]).
