In this bail bond dispute, surety, Pioneer General Insurance, and its agent, Robert Sil-burn (collectively "surety"), appeal from the trial court judgment requiring refund of the premium paid on a bond erroneously issued concerning Christian Jackson, who was not otherwise involved in this case. We affirm.

The relevant facts are not in dispute. Felony drug charges were filed against a single defendant, Jack Gonzales, in this case. On October 28, 1999, Gonzales was released from custody on a $5000 bond posted by a different surety. Gonzales thereafter failed to appear as…
