1. Introduction

This case is before the court on five Motions to Dismiss (e.g., Docs. #208, 210, 211, 212, 213, Case No. 2:12-cv-02169-RDP) that have been filed by nine of the thirty-eight Defendant Blue Plans1 (collectively referred to as “Moving Defendants”).
