This is an appeal by Browning-Ferris Industries of Pennsylvania, Inc. (Employer) from a decision of the Unemployment Compensation Board of Review (Board) which affirmed a referees award of benefits to Thomas D. Cook (Claimant) pursuant to Sections 401(d)(1) and 402(e) of the Unemployment Compensation Law (Act) Act of December 5, 1936, Second Ex. Sess., P.L. (1937) 2897, as amended, 43 P.S. §801(d)(1) 1 and §802(e).1 2 We affirm.
