HUTSON-DUNN, Justice.

We grant the motion for clarification, withdraw our original opinion of February 8, 1996, and substitute this opinion in its place.

This is an appeal from a suit for judicial review of the denial of appellant’s application for a wine and beer retailer’s off-premise permit. Appellant, Live Oak Resort, Inc.
