This negligence action is the result of injuries sustained by plaintiff-appellant when he was struck by an automobile as he was standing on a safety island of a private road located on property of the General Electric Company in the city of Schenectady. The automobile was owned by the defendant-respondent and, at the time of the accident, was being operated by Edward Gagnon, who is alleged to have been the agent, servant and employee of defendant-respondent.
