(concurring specially) :

I concur in the foregoing decision except the conclusion that the decision of the District Court of Appeal in this case does not conflict with the decision of this Court in State ex rel. Bailey v. Mayo, 65 So.2d 721. I think it does. We should expressly recede from and overrule Mayo.
