The parties to this appeal occupy the same position as in the superior court of Pottawatomie county, Okla.

The plaintiff filed its petition in the su-lierior court of Pottawatomie county, Okia., in which it alleged that it was a corporation duly organized and doing business under and by virtue of the national banking-laws of the United States. It alleged that it was the owner of and in possession of a certain series of notes which defendant had executed in favor of the Norton Motor Sales Company, of Shawnee, Okla.
