Judgment unanimously reversed, on the law and facts, and a new trial granted. Memorandum: After a jury trial defendant was convicted of criminal possession of a controlled substance in the second degree (Penal Law, §220.18, subd 1) and criminal possession of a weapon in the third degree (Penal Law, § 265.02, subd [4]). He was sentenced to three years to life on the first count and two to four years on the second, the sentences to be served concurrently. Prior to the date of sentencing, defendant discharged his trial counsel and retained his present counsel who moved to set aside the verdict…
