The defendant has been indicted by the grand jury of this county for the crime of “conniving at the auditing and allowance of a fraudulent claim against the city of New York.”
Upon his arraignment the defendant questioned the sufficiency of the evidence to warrant the finding of the indictment, and, to the end that he might thereupon move that the indictment be set aside, he has asked that he be allowed to inspect the minutes of the testimony presented to the grand jury.
