MEMORANDUM OPINION
SLEET, District Judge.
I. INTRODUCTION
On May 28, 1999, the plaintiff in this case, Ensug Choe-Rively, 1 (“Choe-Rively”) filed a complaint against Vietnam Veterans of America, Chapter 83, New Castle County Delaware, Inc. (“Chapter 83”) and Vietnam Veterans of America, Inc. (the “WA”) (D.I.1). 2 Choe-Rively filed a separate suit on July 7, 1999 (99-430-GMS, D.I.l). Although the second action included several different parties and claims, the court consolidated the two cases on May 22, 2000. The parties have filed cross claims as well as amended complaints and answers.
