This is an action instituted in the County Court by Ed. F. Dupree against the City of Houston for damages to a mule belonging to plaintiff and alleged to have been hired by him to the city, and which was alleged to have been hitched, by direction of the foreman in charge of the work, to a flat-car loaded with gravel for the purpose of moving it a short distance, and which was injured while engaged in such work.
