Dissenting. — This is a proceeding of ouster, brought under C. S., sec. 8684, to remove appel'lant D. F. Clark from the office of -trustee of independent school district No. 1, which includes the city of Twin Falls, and to recover the $500 penalty provided for by the statute.

The charging part of the information is “that the defendant has neglected and refused to perform the official duties pertaining to the office held by him in that the board of trustees of said school district including the defendant neglected and refused,” etc.; and then follow thirty-eight counts, each…
