■ The question before us is whether the judgment of the Madison county court ap*785pointing Russell McKeehan guardian of his three month old daughter, Russelita, is void. The chancellor held the appointment void and for that reason set aside a former judgment of the Madison circuit court approving a sale of the infant’s real estate, and this appeal followed.
