Jose Manuel Rodriguez-Garcia ("Rodriguez"), a citizen of Mexico, pleaded guilty to the Class B misdemeanor offense of possessing two ounces or less of marihuana. See Tex. Health & Safety Code Ann. § 481.121 (West 2010). The trial court assessed his punishment at one day in the county jail. He did not appeal.
