OVERVIEW

Defendant-appellant John Roy Robinson appeals his sentence following a guilty plea to one count of unarmed bank robbery in violation of 18 U.S.C. § 2113(a). Robinson argues that application of the Federal Sentencing Guidelines, which had been declared unconstitutional by this court at the time of his offense, is a violation of the Due Process and Ex Post Facto Clauses of the Constitution.
