MATHES, District Judge.
By this action plaintiff seeks an injunction restraining further alleged infringement and unfair competition in the use of plaintiff’s trade-mark and trade name “Las Palmas”; also threefold damages and other equitable relief.
The original jurisdiction of this court is invoked under the Trade-Mark Act of 1946 — the Lanham Act. 60 Stat. 427 (1946), 15 U.S.C.A. §§ 1051-1127; 28 U.S.C. § 1338(a).
