OPINION

FOWLER, Justice.

Appellant, Chad Herbert Gifford (“Gif-ford”), appeals from his conviction of one count of Aggravated Assault and one count of Deadly Conduct. See TexPenal Code Ann. §§ 22.02, 22.05 (Vernon 1994). The trial court, after hearing evidence, sentenced Gif-ford to five years imprisonment in the Texas Department of Criminal Justice, Institutional Division. Gifford appeals on five points of error. We reverse the trial court’s sentence.
