HALL, Chief Justice.

The appellee, Nanes, filed this suit .against the appellant to recover upon a policy of insurance issued by appellant June 1, 1.934, upon the life of Margarita Nanes, his wife, alleging that she died July 12, 1934. He seeks to recover $500, the face of the policy, and interest, prays for 12 per cent, penalty and $150 attorney’s fees.
