These appeals are from orders entered by the court below in recount proceedings instituted by petitions filed as authorized by Article XVII, section 1701, of the Election Code of 1937, P. L. 1333.

At the election held November 4, 1941, C. William Kreisher was the Republican candidate and Hervey B. Smith was the Democratic candidate for the office of judge of the court of common pleas for the twenty-sixth judicial district, comprising Columbia and Montour counties.
