Milton Martin was brought before the Mayor and the Board of Aldermen of the City of Waynesboro, for a public disciplinary hearing, on March 5, 1987. After the hearing, he was suspended without pay for sixty days, by unanimous vote. On March 13, 1987, Martin filed a timely appeal in the circuit court for due process violations and the city’s failure to meet its burden of proof.
