Respondent, Ronald Collins, was indicted for possession of cocaine in violation of N.J.S.A. 24:21-20. He applied for pretrial intervention (PTI) pursuant to N.J.S.A. 2C:43-12 et seq. of the Code of Criminal Justice (Code). The prosecutor denied the application, taking the position that Collins was ineligible for diversion because of a previous conviction of a controlled dangerous substance offense.
