As detailed in our prior decisions in this matter (Matter of Troy Sand & Gravel Co., Inc. v Town of Nassau, 82 AD3d 1377 [2011]; 80 AD3d 199 [2010]), in 2004, petitioner Troy Sand & Gravel Company, Inc. submitted applications to respondent Town of Nassau for a special use permit and site plan approval for a quarry it proposed to establish on a parcel of land in the Town of Nassau, Rensselaer County.
